Wheeler Charges Set Aside

Charges against the suspect in a 23-year old cold case have been set aside.

Yesterday, White County Circuit Judge Robert Edwards signed the order not to prosecute 42-year old Brandon Lee Wheeler, of Weatherford, Texas, who had been charged with capital murder and felony abuse of a corpse in the 1994 disappearance of Searcy resident Jarrod Delvin Green.

Daily Citizen reports 17th Judicial District Prosecuting Attorney Becky McCoy said the state decided not to proceed with the case for the moment because “the evidence that we expected to have by now, we don’t have.”

Authorities say a pond that is still being drained is where they believe there is evidence of the 20-year-old Green’s murder.

McCoy said she expected it to be completed by now but it hasn’t.

Searcy Police Department investigators are actively seeking more evidence to prosecute Wheeler for the crime, McCoy said.

Wheeler was arrested in Jefferson County, Ohio, on May 10th and was extradited to the White County Detention Center on May 21st.
